Duo charged with trafficking 5,008gm of syabu

KOTA KINABALU: Two men were jointly charged with trafficking in 5,008gm of syabu. However no plea was taken from Andy Lim Shau Seng, 31 and Yei Yung Chin, 35 who were brought before Magistrate Stephanie Sherron Abbie.

They allegedly trafficked the drugs in front of Kedai Yuen, Jalan Gaya at about 4.15pm on Aug 29 recently. The offence framed under Section 39B (1)(a) of the Dangerous Drugs Act 1952, provides for the mandatory death penalty.

They will be further remanded as the offence is non-bailable.

Andy is represented by counsel Dato’ Rakhbir Singh while Yei by counsel Cedric Chu. Meanwhile, the same court ordered a 23-year old man to serve five years’ jail from the date of arrest and to be whipped three times.

Stephanie passed the sentence on the accused who was charged under Section 39C (1) (b) DDA 1952 which carries a jail term of not less than five years and not exceeding seven years and whipping of not more than three strokes.

It was revealed that Kamja Ali Nathan is a habitual drug offender who had serve time on four occasions for drug offences.

He was caught with the drug at the Kota Kinabalu Prison on August 9 at 10:00am. Chief Insp Lim Swee Beng handled both cases.

Meanwhile in another Magistrate’s Court, a 34-year-old mechanic pleaded not guilty to assaulting his son. Magistrate Cindy Mc Juce Balitus fixed case management on Oct 10 for Mohd Yusran Yusof, after he denied committing the offence at Kampung Gentisan, Manggatal at about 2.30pm on Oct 15 last year.

The undefended accused is charged under Section 323 of the Penal Code which carries a jail term of up to a year or a fine of up to RM2,000, or both, on conviction.

The court ordered Mohd Yusran to be further remanded under Section 250 of the Criminal Procedure Code. Insp P. Nathan acted for the prosecution. – NEDM & MIH
